Each Vendor with access to KB Trade Partners Online (kbtradepartners.com) is solely responsible for keeping its account and Vendor login/access credentials (which include any Vendor IDs, passwords, confirmation/authorization codes or other unique identifiers or security procedures) confidential and secure. Each Vendor is cautioned to change its access credentials periodically to ensure continued security. Each Vendor agrees to immediately notify KB Home of any unauthorized use or breach of Vendor's account or login/access credentials, or any other breach of security of KB Trade Partners Online known to Vendor, by sending an email to araccpa@kbhome.com. In addition, each Vendor is solely responsible for all use of and all activities conducted with or attributable to its account or login/access credentials or that originate from its systems (whether or not any such use or activity is authorized by or undertaken with the knowledge of Vendor), and shall be solely responsible for any loss, liability or damage of any kind suffered by KB Home or its officers, directors, employees, agents, affiliates and/or subsidiaries, or by any other Vendor or user of KB Trade Partners Online, or by any other third party, as a result of, in connection with or in any way arising from the use or disclosure of Vendor's account or login/access credentials.

Each Vendor agrees that KB Home and its officers, directors, employees, agents, affiliates and/or subsidiaries shall not be liable for any loss, liability or damage that Vendor may suffer as a result of, in connection with or in any way arising from any use of Vendor's account or login/access credentials (whether or not such use is authorized by or undertaken with the knowledge of Vendor), or any inability to use KB Trade Partners Online as intended, including, without limitation, any direct or indirect, special, incidental or consequential losses, liabilities, damages or expenses of any kind. KB Home makes no warranty of any kind, whether implied, expressed or statutory, including, without limitation, the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, with respect to the operation of KB Trade Partners Online. Therefore, each Vendor accepts, at its own risk, that KB Trade Partners Online may not perform as intended despite the efforts of KB Home, Vendor's Internet service provider, or Vendor.
